Rule 44-36. Fee on Motion To Open Certain Judgments

Upon the filing of a motion to open judgment in any case in which the defendant has been charged with violation of a motor vehicle statute and has failed to appear at the time and place assigned for trial or, where applicable, has failed to plead or pay the fine and additional fee by mail, and the judicial authority has reported such failure to the Commissioner of Motor Vehicles, the movant shall pay to the clerk the filing fee prescribed by statute unless such fee has been waived by the judicial authority.
