Rule 8-113. Court Papers—Duty of Clerk
(a) Opinions All opinions of the Court shall be filed with the Clerk. The Clerk shall deliver a certified copy of each opinion to be reported to the State Reporter for inclusion in the State Reports.
(b) Record on Appeal
(1) Request by Governor--Criminal Cases When requested by the Governor, the Clerk may send to the Governor the record on appeal in a criminal case. The Clerk shall obtain a receipt.
(2) For Preparation of Record Extract When necessary for preparation of a record extract and on request of a party, the Clerk may send all or part of the record on appeal to a commercial printer or photocopier for reproduction.
(3) Removal to State Archives The Clerk shall deliver the original records to the State Archives for permanent retention in accordance with the procedures established by the State Archivist and Records Management Division.
(c) Other Court Papers Except as otherwise provided in this Rule, the Clerk shall not release any original court paper without permission of the Court and the receipt of the party to whom it is delivered.
